Introduction
These terms and conditions (“terms”) govern the relationship between Palm Shores Travel LLC ("PST LLC” “we," "our," or "us") and you the purchaser or traveler ("you," "your," or “Client"). By planning travel with Palm Shores Travel LLC, you agree to be bound by these terms and acknowledge that Palm Shores Travel LLC acts solely as a booking agent for disclosed principal tour operators, cruise lines, hotels, airlines, ground transportation, and other independent contractors (“Suppliers”, “Supplier”) and is not the source or provider of the travel services. These terms include warranties and disclaimers, and exclusions of liability that may restrict your rights and remedies and provide protection to Palm Shores Travel LLC.
Use of Services and Privacy Policy
You confirm that you are at least 18 years old and have the legal authority to enter into this agreement and make travel bookings with PST LLC. You acknowledge that you have read, understood, and accepted these Terms and Conditions. You agree to be financially responsible for all travel bookings made through PST LLC, whether for yourself or on behalf of others in your travel party. You warrant that all information provided on behalf of yourself, your household, or others authorized to book through PST LLC is true and accurate. You further agree to make only legitimate reservations or purchases and understand that speculative, false, or fraudulent bookings are strictly prohibited. PST LLC acts solely as a booking agent for the travel suppliers listed in your itinerary. Each supplier has its own terms and conditions, and by booking through PST LLC, you agree to abide by those terms. PST LLC is not responsible for any independently arranged travel, including associated costs, fees, cancellations, or itinerary changes, and cannot provide assistance with arrangements not booked through us. We are committed to protecting your privacy and handling your data in compliance with applicable laws. Personal data will only be shared with the Supplier as needed to complete your booking.
Ownership of this site and its content
PST LLC owns all intellectual property rights in (a) all text, logo, images, headers, trademarks, service marks, design elements, and all other protected elements on the Sites (except those licensed from others); (b) all things otherwise provided to you as a part of the PST LLC’s services, and; (c) any other intellectual property rights afforded to PST LLC, either through state or federal registration or as otherwise available at common law (“Intellectual Property”). Except as stated within, PST LLC does not grant you any rights to any Intellectual Property that may be available to you generally through the Site. You agree not to make unauthorized use of or otherwise infringe upon the Site’s Intellectual Property in any way and understand that it is your responsibility to ensure you refrain from doing so.
Payments, Changes, and Cancellations
All bookings are subject to availability and confirmation by the respective travel service providers. A deposit is required to confirm all reservations. PST LLC is not responsible for changes or cancellations made by these providers. The client is fully responsible for all charges, fees, duties, taxes, and assessments related to travel bookings made through PST LLC. By submitting a credit card authorization to PST LLC, you authorize the use of your payment method to purchase travel products from suppliers on your behalf. Final payments must be made by the deadline specified in your invoice or in accordance with each Suppliers terms and conditions. You understand that failure to make final payment or comply with a Suppliers purchase conditions may result in the cancellation of reservations, denial of access to flights, tours, hotels, cruises, or other travel services, and the forfeiture of any payments made. Only major credit cards are accepted for payment. You understand once a booking is confirmed and a deposit is made, refunds may not be available. Changes or cancellations to your travel plans may not qualify for a refund. All changes or cancellation requests must be submitted to PST LLC in writing to tracy@palmshorestravel.com. Cancellation penalties from both PST LLC and third-party suppliers will apply. Any applicable cancellation fees will be deducted from a supplier refund or charged to the authorized credit card. PST LLC reserves the right to impose a $200 cancellation fee on bookings that do not include travel insurance. Certain bookings may be non-changeable, and you are responsible for any additional costs or fees imposed by the supplier. Except in cases of fraud, you agree not to dispute or charge back any payment with your bank or credit card company to circumvent the booking terms and conditions of PST LLC or its suppliers, including cancellations or itinerary changes beyond their control. If you initiate a chargeback, reversal, or recollection of a previously authorized payment, PST LLC reserves the right to recover all associated costs, fees, and expenses, including, but not limited to, attorney’s fees.
Identification and Travel Documentation
Clients are responsible for obtaining and carrying a valid passport book, necessary visas, and any other required travel documents per the regulations of their destination. Passports must be valid for at least six (6) months beyond the anticipated return date. Clients must also secure any required vaccinations or medical documentation for their travel. Non-U.S. citizens must inform PST LLC if traveling on a non-U.S. passport. Every country has different policies regarding past criminal offenses. Children and infants must have appropriate travel documents. Those traveling with only one parent or without both parents may be denied entry without verified consent forms. If you have a current or prior offense, consult the destination country directly regarding entry and exit requirements. In respecting client privacy, PST LLC does not inquire about criminal records. PST LLC does not control or guarantee visa issuance or visa waiver approvals and is not responsible for lost trip payments due to failure to obtain proper documentation. Entry and exit regulations are subject to change at any time. The U.S. Transportation Security Administration (TSA) and the U.S. Department of Homeland Security (DHS) recommend that all travelers carry acceptable identification to board a flight. For details, visit www.tsa.gov. Any discrepancy between your reservation and travel documentation may result in denied boarding or delays at airport security, potentially causing you to miss your flight and any subsequent travel arrangements, including cruises and tours. Upon receipt of your travel documents, it is your responsibility to review and verify all information for accuracy. If any changes or corrections are necessary, you must contact PST LLC immediately. If you do not notify us of the required corrections within 24 hours of receiving your travel documents, PST LLC will not be responsible for any additional costs incurred in making the necessary corrections.
Air Travel
Your airline ticket constitutes a contract between you and the air carrier, even if purchased through PST LLC. You acknowledge and agree that PST LLC does not control the operations of independent airlines and is not liable for any personal injury, property damage, or other issues related to the purchase of your airline tickets or air travel. This includes but is not limited to acts, errors, omissions, injuries, losses, accidents, delays, failures to deliver services, partial or inadequate service delivery, airline refund or rebooking policies, baggage fees, bankruptcy or cessation of operations, or air schedule changes. Due to enhanced security, it is strongly recommended that you check in at least two (2) hours prior to the scheduled departure time for domestic flights and three (3) hours for international flights. It is your responsibility to reconfirm flight times at least 24 hours prior to departure for domestic flights and 72 hours prior for international flights. PST LLC is not liable if the airline changes fare classes, frequent flyer miles, or loyalty status. Seat assignments are not guaranteed, even after they have been assigned, and PST LLC has no control over seat assignments.
Travel Insurance
PST LLC highly recommends and offers access to travel insurance to protect clients against unforeseen events, such as cancellations, medical emergencies, and lost luggage. Unless specifically stated, travel insurance is not included in the cost of the Client’s itinerary. By opting not to purchase travel insurance, you understand and agree that if you cancel or interrupt your travel for any reason, certain portions of your trip may not be refunded, and cancellation penalties from PST LLC and travel suppliers may apply, potentially resulting in the loss of funds up to the full cost of your travel booking. The purchase of travel insurance is not mandatory to purchase any other product or service offered by PST LLC. However, if you decline to purchase insurance, PST LLC may require you to sign an insurance waiver. PST LLC is not a licensed insurance broker and is not authorized to answer technical questions regarding benefits, exclusions, or conditions of any insurance offered, nor to evaluate the adequacy of your existing coverage. It is your responsibility to review your insurance policy to understand its coverage and to secure alternative coverage, if necessary, for conditions excluded by your policy. PST LLC cannot guarantee that any insurance provider will approve coverage for claims under its policy and makes no representations regarding the extent of coverage provided by any insurance policy it offers. An additional charge will apply for any travel insurance purchased.
Risks and Safety
Travel to certain destinations may carry higher risks than others. PST LLC strongly encourages clients to stay informed about current events and to review travel restrictions, warnings, announcements, and advisories issued by the United States Government before booking travel to international destinations. The Smart Traveler Enrollment Program (STEP) is a free service offered by the U.S. government for U.S. citizens traveling to or living in a foreign country. STEP allows travelers to provide details of their trip so the Department of State can assist in case of an emergency. Registration can be done at https://mytravel.state.gov/s/step. By offering travel to certain destinations, PST LLC does not imply that travel to those destinations is advisable or without risk, and shall not be held liable for any costs, damages, or losses resulting from travel to such locations.
Responsibility, Liability, and Force Majeure
PST LLC acts solely as a booking agent for the Supplier and is not the source or provider of any travel services. You agree that PST LLC cannot be held liable for any loss, injury, or damage resulting from any act or omission by a Supplier. Each Supplier is an independent entity with its own management and is not subject to the control of PST LLC. The Supplier listed in your travel documentation is responsible for providing the travel services purchased, and you consent to use their services. Any alteration to an itinerary is at the sole discretion of the Supplier, and PST LLC is not responsible for any changes. PST LLC will not be in breach of these terms and conditions, nor liable for any failure or delay in fulfilling obligations under this agreement, if such failure or delay is caused by circumstances beyond its reasonable control. These include, but are not limited to, acts of God, accidents, riots, war, terrorist acts, epidemics, pandemics, quarantines, civil commotion, breakdown or malfunction of equipment (including web hosts and Internet service providers), destruction of or serious damage to facilities, natural disasters, governmental acts or omissions, changes in laws or regulations, national strikes, or other unforeseen events outside PST LLC’s control. Additionally, each Supplier has its own terms and conditions, which include force majeure provisions. In the event of a force majeure occurrence, the Supplier may, at its sole discretion, vary, postpone, or cancel any itinerary or arrangement related to the trip. The payment of any refund due to you for the nonperformance of any obligations remains at the sole discretion of the Supplier, pursuant to their policies.

WE MAKE NO REPRESENTATIONS OR WARRANTIES WITH RESPECT TO THIS SITE OR ITS CONTENT, OR ANY PRODUCT OR SERVICE AVAILABLE ON OR PROMOTED THROUGH THIS SITE. THIS SITE AND ALL OF ITS CONTENT (INCLUDING USER-GENERATED CONTENT) ARE PROVIDED ON AN “AS IS,” “AS AVAILABLE” BASIS, WITHOUT REPRESENTATIONS OR WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE, ITS FRANCHISES AND AFFILIATES, AND THEIR SERVICE PROVIDERS AND LICENSORS DISCLAIM ANY AND ALL REPRESENTATIONS AND WARRANTIES, WHETHER EXPRESS, IMPLIED, ARISING BY STATUTE, CUSTOM, COURSE OF DEALING, COURSE OF PERFORMANCE OR IN ANY OTHER WAY, WITH RESPECT TO THIS SITE, ITS CONTENT, AND ANY PRODUCTS OR SERVICES AVAILABLE OR PROMOTED THROUGH THIS SITE. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAWS WE, ON BEHALF OF OUR DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, LICENSORS AND SERVICE PROVIDERS, EXCLUDE AND DISCLAIM LIABILITY FOR ANY LOSSES AND EXPENSES OF WHATEVER NATURE AND HOWSOEVER ARISING INCLUDING, WITHOUT LIMITATION, ANY DIRECT, INDIRECT, GENERAL, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES; LOSS OF USE; LOSS OF DATA; LOSS CAUSED BY A VIRUS; LOSS OF INCOME OR PROFIT; LOSS OF OR DAMAGE TO PROPERTY; CLAIMS OF THIRD PARTIES; OR OTHER LOSSES OF ANY KIND OR CHARACTER, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR LOSSES, ARISING OUT OF OR IN CONNECTION WITH THE USE OF THIS SITE. Severability
If any provision of these Terms and Conditions is held by a court of competent jurisdiction to be contrary to law, such provision will be changed and interpreted so as to best accomplish the objectives of the original provision to the fullest extent allowed by law and the remaining provisions of these Terms of Use will remain in full force and effect.
Changes to Terms and Governing Law
PST LLC reserves the right, at its sole discretion, to modify these Terms and Conditions at any time. It is the Client’s responsibility to review the terms periodically. Your continued use of our services after such modifications will constitute your acceptance of the updated terms. These Terms are governed by and construed in accordance with the laws of the State of Missouri. Any disputes shall be resolved in the courts of Missouri. Any claims against PST LLC must be filed within 12 months following the completion date of the trip. PST LLC shall not be liable for any damages other than compensatory damages, and you waive any right to seek punitive or exemplary damages. You agree that any claims may only be brought in your individual capacity and not as a plaintiff or class member in any class action or other representative proceeding.
